Please read these terms carefully. By accessing or using any EaglerNodes service, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

1. About EaglerNodes

EaglerNodes ("we", "us", "our") is a server hosting provider based in England and Wales, operating under the domain eagler.cc. These Terms of Service govern your access to and use of all hosting services, websites, and related products provided by EaglerNodes.

These Terms constitute a legally binding agreement between you ("the Client", "you", "your") and EaglerNodes. They are governed by the laws of England and Wales.

2. Eligibility

To use our services you must be at least 13 years of age. If you are under 18 years of age, you must have the consent of a parent or legal guardian. By agreeing to these Terms you represent and warrant that you meet these requirements.

We reserve the right to refuse service to any person or entity at our sole discretion.

3. Account Registration

To access our services you must register for an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain and promptly update your account information.
Keep your account credentials confidential and not share them with third parties.
Accept responsibility for all activity that occurs under your account.
Notify us immediately of any unauthorised access or security breach.

We reserve the right to suspend or terminate accounts that contain false, inaccurate, or misleading information.

4. Services

EaglerNodes provides server hosting and related infrastructure services. We will use reasonable endeavours to ensure availability of the services but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible.

We reserve the right to modify, suspend, or discontinue any service with reasonable notice. In the event of discontinuation, we will provide a pro-rated refund for any unused, prepaid service period.

5. Acceptable Use

Your use of our services is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree to comply with it in full at all times.

6. Payment and Billing

All prices are stated in GBP (British Pounds Sterling) and are inclusive of VAT where applicable, in accordance with the Value Added Tax Act 1994.

Payment is due in advance of each billing period. Failure to pay may result in suspension of services. We use third-party payment processors; your payment information is subject to their terms and privacy policies.

Chargebacks initiated fraudulently will result in immediate account termination and may be subject to a chargeback fee.

7. Refund Policy

Refund requests are assessed on a case-by-case basis. We aim to be fair and reasonable in line with your rights under the Consumer Rights Act 2015. As a consumer, you may have a 14-day right of cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 for digital services, unless you have expressly requested that service delivery begin immediately, in which case cancellation rights may be waived.

No refunds will be issued for accounts suspended or terminated due to violation of these Terms.

8. Service Level Agreement

We target 99.9% monthly uptime for our hosting infrastructure. In the event of downtime attributable to EaglerNodes that exceeds this threshold, you may be eligible for service credits at our discretion. This SLA does not apply to downtime caused by scheduled maintenance, force majeure events, client-side actions, or third-party service failures.

9. Data and Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process personal data in accordance with UK GDPR and the Data Protection Act 2018. You retain ownership of all data you store on our infrastructure.

We will not access your data except where necessary to provide the services, comply with a legal obligation, or respond to a valid legal request from a competent authority.

10. Intellectual Property

All content, branding, trademarks, and intellectual property displayed on the EaglerNodes website and platform are the property of EaglerNodes or our licensors. Nothing in these Terms grants you any right to use our intellectual property without express written permission.

You retain all intellectual property rights in any content you upload or host through our services.

11. Limitation of Liability

To the fullest extent permitted by law, EaglerNodes shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, including but not limited to loss of data, loss of profits, or business interruption.

Our total liability to you shall not exceed the amount paid by you to EaglerNodes in the three months preceding the event giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by English law.

12. Indemnification

You agree to indemnify and hold harmless EaglerNodes, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of our services or your breach of these Terms.

13. Termination

You may cancel your account at any time by contacting us. We may suspend or terminate your account and access to our services at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, to us, or to third parties.

Upon termination, your right to use our services will immediately cease. We may delete your data after a 7-day grace period following termination, unless we are required to retain it by law.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on our website or by sending an email to the address associated with your account. Your continued use of our services after the effective date of the revised Terms constitutes your acceptance of the changes.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We encourage you to contact us in the first instance to attempt to resolve any dispute informally before commencing formal legal proceedings.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and EaglerNodes with respect to the subject matter herein and supersede all prior agreements, representations, and understandings.
